Overview
Welcome to STIQ! The terms "we", "us" and "our" refer to STIQ, a trading name of BIOXY ENTERPRISES S.L.. STIQ operates this store and website, including all related information, content, features, tools, products and services, in order to provide you, the customer, with a curated shopping experience (the "Services"). STIQ is powered by Shopify, which enables us to provide the Services to you.
The below terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms") describe your rights and responsibilities when you use the Services.
By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or Privacy Policy, you should not use or access our Services.
SECTION 1 - ACCESS AND ACCOUNT
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your country of residence. To use the Services, you may be asked to provide information such as your email address, billing, payment, and shipping information. You represent and warrant that all information you provide is correct, current and complete.
You are solely responsible for maintaining the security of your account credentials and for all of your account activity. You may not transfer, sell, assign, or license your account to any other person.
SECTION 2 - OUR PRODUCTS
We have made every effort to provide an accurate representation of our products in our online store. Colors or appearance may differ from your screen due to your device settings. Product descriptions are subject to change at any time. We reserve the right to discontinue any product or limit quantities offered.
SECTION 3 - ORDERS
When you place an order, you are making an offer to purchase. STIQ reserves the right to accept or decline your order. Your order is not accepted until STIQ confirms acceptance and payment has been processed. You represent and warrant that your purchases are for personal or household use and not for commercial resale.
SECTION 4 - PRICES, BILLING AND PAYMENT METHODS
Prices, discounts and promotions are subject to change without notice. The price charged will be the price in effect when the order is placed, shown in your order confirmation email. Unless expressly stated, posted prices do not include taxes, shipping, handling, customs or import charges. Invoices are issued in electronic format by default.
Accepted payment methods: Visa, Mastercard, American Express, PayPal, Apple Pay, and Google Pay.
SECTION 5 - SHIPPING AND DELIVERY
Shipping costs, carriers, and estimated delivery times are set out in our Shipping Policy.
SECTION 6 - RIGHT OF WITHDRAWAL
If you are a consumer residing in the European Union, you have the right to withdraw from your purchase within 14 calendar days of receiving your order. For health and hygiene reasons, withdrawal is not accepted where the protective seal or packaging has been opened after delivery, except where the product is defective; products must be returned unused, in perfect condition, and properly packaged.
Once you notify us of your withdrawal, we will refund the amount paid, including standard delivery costs, within 14 calendar days, using the same payment method used for the purchase; return shipping costs are borne by the consumer. SECTION 7 - RETURNS
STIQ does not offer a discretionary returns or exchange program beyond the legal right of withdrawal described in Section 6 above. This does not affect your statutory warranty rights for defective, damaged, or incorrect products (see Section 8 below), which you may claim by contacting our Customer Service team at contact@bioxy.co.
SECTION 8 - LEGAL WARRANTY OF CONFORMITY
All products sold include the legal warranty of conformity provided for under Spanish law, currently up to 3 years from the date of delivery. Contact our Customer Service team, we will assess the claim.
SECTION 9 - INTELLECTUAL PROPERTY
Our Services, including trademarks, brands, text, displays, images, graphics, and design, are owned by BIOXY ENTERPRISES S.L., its affiliates or licensors, and are protected by applicable intellectual property laws. You may use the Services for personal, non-commercial use only, and must not reproduce, distribute, or create derivative works from any material without our prior written consent.
SECTION 10 - OPTIONAL TOOLS
You may be given access to third-party tools that we neither monitor nor control. Such tools are provided "as is" and "as available," without warranties, and we accept no liability arising from your use of them, without prejudice to any rights you may have as a consumer under mandatory law.
SECTION 11 - THIRD-PARTY LINKS
The Services may contain links to third-party websites. We are not responsible for examining or evaluating their content or accuracy. If you leave our Services to visit a third-party site, you do so at your own risk.
SECTION 12 - RELATIONSHIP WITH SHOPIFY
STIQ platform is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with STIQ / BIOXY ENTERPRISES S.L. Shopify is not responsible for any aspect of any sales between you and STIQ.
SECTION 13 - PRIVACY POLICY
All personal information we collect through the Services is subject to our Privacy Policy. Certain personal information may also be subject to Shopify's Privacy Policy. By using the Services, you acknowledge that you have read both policies.
SECTION 14 - FEEDBACK
If you submit ideas, suggestions, or other feedback ("Feedback"), you grant us a perpetual, worldwide, royalty-free license to use it for any purpose, including commercial use. You represent that you own or have rights to all Feedback submitted, and that it complies with these Terms.
SECTION 15 - ERRORS, INACCURACIES AND OMISSIONS
Our Services may occasionally contain typographical errors or omissions relating to product descriptions, pricing, or availability. We reserve the right to correct these and to cancel orders affected by inaccurate information, without prior notice, without prejudice to your statutory consumer rights.
SECTION 16 - PROHIBITED USES
You may not use the Services for any unlawful purpose, to infringe intellectual property rights, to transmit false information, to harass others, or to interfere with the security of the Services. You must not upload malicious code, scrape data, or use automated tools to access the Services without authorization.
SECTION 17 - AGENTS
This section applies if you use, allow, or cause the deployment of an autonomous or semi-autonomous software "Agent" to access the Services. Any such Agent must identify itself as such in all requests, must not conceal that it is automated, and must not attempt to bypass CAPTCHAs or access controls.
SECTION 18 - TERMINATION
We may terminate this agreement or your access to the Services at our discretion, without notice, and you will remain liable for amounts due up to the date of termination. Provisions that by their nature should survive termination (including Intellectual Property, Limitation of Liability, and Governing Law) will continue to apply.
SECTION 19 - DISCLAIMER OF WARRANTIES
The information presented on or through the Services is provided for general informational purposes only. We do not warrant the accuracy, completeness, or usefulness of this information, and reliance on it is at your own risk, to the extent permitted by law.
Nothing in this clause excludes, limits, or is intended to exclude or limit:
- The legal warranty of conformity of the products (see Section 8 above);
- Your legal right of withdrawal (see Section 6 above);
- Any other non-waivable right granted to consumers under applicable Spanish or EU law.
Subject to the above, and to the extent permitted by law, the Services are provided "as is" and "as available," without warranties of any other kind, including implied warranties of merchantability or fitness for a particular purpose, except where such warranties cannot be lawfully excluded.
SECTION 20 - LIMITATION OF LIABILITY
To the fullest extent permitted by law, STIQ / BIOXY ENTERPRISES S.L. will not be liable for indirect, incidental, or consequential damages arising from your use of the Services, except where the law does not permit limiting such liability (for example, in cases of wilful misconduct, gross negligence, or personal injury), and without prejudice to liability arising from the legal warranty of conformity of the products (Section 8) or your right of withdrawal (Section 6).
SECTION 21 - INDEMNIFICATION
You agree to indemnify and hold harmless STIQ / BIOXY ENTERPRISES S.L., Shopify, and their affiliates from losses or claims arising from your breach of these Terms, your violation of any law or third-party rights, or your use of the Services, to the extent permitted by applicable law.
SECTION 22 - SEVERABILITY
If any provision of these Terms is found unlawful, void, or unenforceable, that provision will be enforced to the fullest extent permitted by law, and the remainder of these Terms will remain in effect.
SECTION 23 - WAIVER; ENTIRE AGREEMENT
Our failure to enforce any right or provision of these Terms will not constitute a waiver. These Terms, together with any referenced policies, constitute the entire agreement between you and us regarding your use of the Services.
SECTION 24 - ASSIGNMENT
You may not assign or transfer these Terms without our prior written consent. We may assign or transfer these Terms without notice to you.
SECTION 25 - GOVERNING LAW AND JURISDICTION
These Terms are governed by Spanish law. If you are a consumer residing in the European Union, you retain all rights granted to you under the consumer protection laws applicable in your country of residence, including any rights regarding jurisdiction. Unless otherwise required by law, any dispute shall be subject to the jurisdiction of the Courts of Madrid, Spain.
SECTION 26 - ONLINE DISPUTE RESOLUTION
If you are an EU consumer, you may access the European Online Dispute Resolution platform at: https://ec.europa.eu/consumers/odr and contact our Customer Service team at contact@bioxy.co.
SECTION 27 - HEADINGS
The headings used in these Terms are included for convenience only and do not limit or affect their interpretation.
SECTION 28 - CHANGES TO TERMS OF SERVICE
We may update these Terms of Service from time to time by posting changes to our website. We will notify you of material changes as required by applicable law. Your continued use of the Services after changes are posted constitutes acceptance of those changes.
